Article 1 - Company identification

Article 2 - Purpose and scope

These Terms and Conditions of Sale (the “Terms”) exclusively govern the contractual relationship between Symbio3D and its customers, whether businesses or consumers, for any order placed on the website www.symbio3d.com.

2.1 Services offered
  • Online 3D printing: manufacture of parts from 3D files supplied by the customer
  • 3D modelling: creation or modification of 3D files according to the customer's specifications
  • Project support: comprehensive support throughout customer projects
  • Batch 3D printing: small and medium production runs from 3D files supplied by the customer
  • Inventory optimisation: virtualisation of selected parts from the customer's inventory so they can be printed on demand
  • Technical advice: guidance on 3D printing projects
2.2 Exclusions

These Terms do not apply to orders relating to:

  • medical devices or items that could be used as such
  • counterfeit items or items infringing intellectual property rights
  • weapons or dangerous items
  • parts intended for safety-critical use without prior validation
2.3 Technical scope and limits of use

Symbio3D carries out prototyping and additive manufacturing (3D printing) activities, consisting of the production of mock-ups, prototypes, demonstration parts and non-critical, non-structural plastic parts, from digital files supplied by the customer or produced in-house from instructions (diagrams, sketches or specifications).

The parts manufactured are intended for non-normative, non-certified uses. They are not subject to any approval, certification or regulatory validation, unless expressly stated in the quotation.

Symbio3D's activity excludes in particular:

  • safety parts,
  • regulated products,
  • devices subject to certification or approval,
  • any integration into critical or high-risk systems (personal safety, transport, medical, etc.), unless a specific technical validation is explicitly provided for in the quotation.

Article 3 - Ordering and validation process

3.1 Quotation and acceptance
  • Quotation request: the customer submits their 3D file and specifications via the website
  • Feasibility analysis: Symbio3D checks the technical compatibility of the file (geometry, minimum wall thicknesses, required supports)
  • Detailed quotation: a quotation stating costs, lead times and materials is sent to the customer (valid for 30 days)
  • Acceptance: the order becomes firm and final upon receipt of the written acceptance of the quotation and of the payment (or the agreed deposit). Lead times only start to run once Symbio3D has received all usable Elements and required validations (see Article 5.1).

Any change requested by the customer after the quotation has been approved (geometry, material, finish, quantity, tolerances, lead times) may require a new quotation and result in an adjustment of the price and lead times.

3.2 Customer files

3.2.1 Rights in and compliance of the files
The customer warrants that they hold all necessary rights to the files, drawings, documents and information provided (the “Elements”). The Elements must be free of viruses or malicious content and compatible with our production systems. Symbio3D reserves the right to refuse any file that is non-compliant, manifestly dangerous or technically unfeasible.

3.2.2 Transmission channel and security of exchanges (B2C & B2B)
The customer chooses the channel used to transmit the Elements (upload area, e-mail, download link, third-party platform, etc.) and undertakes to use a means suited to the volume of the files and, where applicable, to their sensitivity. Symbio3D recommends, where possible, using a secure link (restricted access, limited duration, password) and sending passwords through a separate channel.

3.2.3 Protective measures taken by Symbio3D
Symbio3D implements reasonable measures to protect the Elements after receipt and during processing, in accordance with these Terms and the applicable legal obligations.

3.2.4 Incidents beyond Symbio3D's control - Consumers (B2C)
Consumer customers remain responsible for the confidentiality of the access credentials they use (e.g. e-mail account, storage space, password, sharing settings). Symbio3D cannot be held liable for unauthorised access to the Elements resulting in particular from:

  • a compromise of the customer's account or mailbox;
  • a wrong recipient or an incorrect contact address provided by the customer;
  • a sharing link set as public or insufficiently restricted by the customer;
  • or, more generally, an external event reasonably beyond Symbio3D's control.

This provision does not exclude Symbio3D's liability for any fault attributable to it, nor the consumer's mandatory statutory rights.

3.2.5 Incidents beyond Symbio3D's control - Business customers (B2B)
Business customers are responsible for the choice of transmission channels and their level of security, as well as for managing access rights (recipients, passwords, access restrictions, link duration). Symbio3D cannot be held liable for unauthorised access, interception, loss or disclosure of the Elements resulting from an event occurring beyond its control, in particular in the event of:

  • a compromise of the customer's information system, mailbox or storage;
  • a wrong recipient, uncontrolled sharing, or insufficient configuration of a link;
  • an incident specific to a third-party platform chosen by the customer.

This clause does not apply in the event of gross negligence or wilful misconduct on the part of Symbio3D.

3.2.6 Personal data in the files
The customer undertakes to include in the Elements only such personal data as is strictly necessary for the performance of the order. The processing of such data is governed by Article 10 “Protection of personal data (GDPR)”.

3.2.7 Subcontracting and access to files / information (B2C & B2B)
Strictly for the purpose of performing the order, Symbio3D may use service providers (the “Subcontractors”) for necessary operations (e.g. transport, hosting, technical tools, maintenance), without transferring to them any rights over the customer's Elements.

Symbio3D may entrust Subcontractors with operations strictly necessary for the performance of the order, including where this involves limited access to the Elements, subject to:

  • access limited to a need-to-know basis;
  • an equivalent written confidentiality undertaking;
  • reasonable security measures;
  • compliance with applicable legal obligations, in particular regarding data protection.

3.2.8 Liability
Symbio3D remains responsible for the proper performance of the order and, where applicable, for compliance with confidentiality obligations by its Subcontractors, within the limits set out in these Terms and the applicable regulations.

3.2.9 Performance on the basis of the Elements provided
Unless expressly stated in the quotation, Symbio3D's services consist of performing the order on the basis of the 3D files, drawings, documents and specifications provided or approved by the customer (the “Elements”). The customer remains responsible for the accuracy, completeness and consistency of the Elements (dimensions, tolerances, functional clearances, critical orientation, assembly constraints, etc.).

3.2.10 No engineering, design or fitness-for-use validation obligation (B2C & B2B)
Unless a service is explicitly included in the quotation (e.g. study, design, sizing, simulation, material/use validation, qualification), Symbio3D is bound only by a best-efforts obligation with respect to:

  • design/engineering (sizing, mechanical calculations, structural validation);
  • suitability for a particular use, a specific environment or regulatory constraints (standards, certifications, product compliance);
  • safety or performance validation for critical use (medical, personal safety, aeronautics, automotive, applications subject to approval, etc.).

Consequently, the customer is solely responsible for the choice of design, materials, parameters and conditions of use of the parts, as well as for the tests and validations required for their end use.

3.2.11 Feasibility check
Any feasibility analysis carried out by Symbio3D (minimum wall thicknesses, supports, risk of failure, orientation, finish) is solely intended to assess manufacturability and/or identify production risks. It does not constitute a functional, regulatory or safety validation of the part, unless expressly stated in the quotation.

3.2.12 Requesting an additional service
If the customer requires a modelling, optimisation, design or material/use validation service, or a specific dimensional tolerance, it must be the subject of a separate order or an explicit mention in the quotation.

3.2.13 Mandatory consumer rights
The above provisions do not limit the statutory rights of consumer customers, in particular under the legal guarantees, nor the contractual information set out in the quotation and service descriptions.

3.2.14 Tolerances - Additive manufacturing (B2C & B2B)
The customer acknowledges that additive manufacturing processes (FDM, SLA/DLP/MSLA, SLS, etc.) inherently involve manufacturing tolerances and possible variations related in particular to geometry, print orientation, supports, machine parameters, material, shrinkage, post-processing and ambient conditions (temperature/humidity). Unless otherwise stated in the quotation, parts are produced to “standard workshop” tolerances.

3.2.15 Appearance variations and finish
Variations in appearance (layer lines, support marks, micro-scratches, colour nuances, texture/gloss variations, small porosities, etc.) may occur and do not, as such, constitute a defect, provided they do not prevent the use intended in the quotation and remain compatible with the level of finish ordered. Any specific aesthetic finishing requirement (polishing, painting, priming, specific surface condition) must be expressly provided for in the quotation.

3.2.16 Critical dimensions and functional fits
Where a part includes critical dimensions (assembly, press fit, sealing, sliding, threads, mechanical stresses), the customer undertakes to:

  • identify them clearly when placing the order (dimensioned drawing, desired tolerances, functional areas);
  • provide, where necessary, functional clearances suited to the process and material;
  • request an additional service (enhanced inspection, machining rework, prototype iterations) if needed.

Failing this, Symbio3D cannot guarantee perfect assembly or unit-level interchangeability, beyond what is specified in the quotation.

3.2.17 Inspection and conformity
The conformity of a part is assessed against the agreed specifications (quotation, drawing, expressly accepted tolerances, level of finish). In the absence of specified tolerances, conformity is assessed according to the usual tolerances of the process and manufacturing constraints.

3.2.18 Mandatory consumer rights
This paragraph does not exclude or limit the legal guarantees applicable to consumers. In the event of a lack of conformity with the quotation or a defect covered by the legal guarantees, the customer retains all of their rights.

3.2.19 Right of refusal - compliance, safety and legality (B2C & B2B)
Symbio3D reserves the right to refuse or not to perform an order, and/or to request additional information, where:

  • the Elements provided are manifestly contrary to the law or public decency, or infringe third-party rights (counterfeiting, copyright, trademarks, designs, etc.);
  • the order relates to prohibited or regulated items, or items likely to constitute a weapon or dangerous object;
  • the stated or reasonably foreseeable use presents a risk to the safety of persons or property, in particular for critical applications (medical, safety, transport, aeronautics, automotive, devices subject to approval), in the absence of appropriate technical validation;
  • production is technically unfeasible, or the risk of failure / poor quality is deemed excessive given the state of the Elements (geometry, tolerances, material, constraints, file defects, etc.).

3.2.20 Declaration - rights and use (B2C & B2B)
Where necessary in view of the risks identified, Symbio3D may ask the customer, before performance, for a sworn declaration confirming:

  • that they hold the necessary rights to the Elements provided (or are authorised to use them);
  • that the intended use is not unlawful and does not contravene the exclusions set out in these Terms;
  • and, where applicable, that the part is not intended for critical use without appropriate technical validation.

If this declaration is not provided within a reasonable time, Symbio3D may refuse or suspend the order.

3.2.21 Interruption during performance
If a ground for refusal arises after production has started (e.g. discovery of a file problem, material incompatibility, manifest non-conformity, safety risk, request for a substantial change), Symbio3D may suspend or interrupt the order and inform the customer, in order to propose an alternative solution (modification, change of material, process adjustment) or to terminate the order under the conditions of Article 3.2.22.

3.2.22 Financial consequences (B2C & B2B)
In the event of refusal or interruption:

  • if no work has started, Symbio3D shall refund the sums received for the order, excluding costs expressly incurred at the customer's request (e.g. specific study, purchase of non-standard material), where such costs were accepted in the quotation;
  • if work has started, Symbio3D shall invoice (or retain) the amount corresponding to the services actually performed and/or the costs incurred, upon supporting evidence (e.g. preparation time, tests, material consumption, specific tooling, purchase of non-standard material), in accordance with the quotation, and shall refund any balance;
  • where the refusal is based on a breach by the customer (unlawful Elements, infringement of third-party rights, inaccurate information, prohibited use), Symbio3D may refuse any refund of the costs already incurred and reserves the right to seek compensation for its loss.

3.2.23 Information and cooperation
The customer undertakes to cooperate promptly (answers, documents, proof of rights, details of use) to enable the order to be analysed and/or brought into compliance. In the absence of a response within a reasonable time, Symbio3D may apply Article 3.2.22.

3.2.24 Compliance with mandatory consumer rights
This paragraph does not limit the public-policy rights of consumer customers, in particular under the legal guarantees, nor Symbio3D's pre-contractual obligations.

3.2.25 Security of files and information
Symbio3D implements reasonable technical and organisational measures to protect the Elements provided by the customer against unauthorised access, alteration, loss or disclosure, to the extent necessary for the performance of the order.

3.2.26 Security incidents and notification (B2C & B2B)
In the event of a security incident affecting the Elements and likely to result in unauthorised access, loss or disclosure, Symbio3D will take reasonable steps to contain the incident and limit its effects, will inform the customer within a reasonable time where the incident is likely to affect the customer's Elements, and, where the incident constitutes a personal data breach within the meaning of the GDPR, will comply with the corresponding legal obligations in accordance with Article 10 “GDPR”.

3.2.27 Limitation of liability - legal framework (B2C & B2B)
Symbio3D cannot be held liable for incidents resulting from an event beyond its reasonable control, in particular: failure of a telecoms operator, widespread attack, vulnerability of a third-party service not chosen by Symbio3D, or compromise of the customer's systems. This provision does not exclude Symbio3D's liability for any fault attributable to it and does not limit the consumer's mandatory rights or the applicable legal obligations.

3.2.28 Retention of files and technical data
Unless otherwise agreed, Symbio3D may retain the Elements and associated technical data for a reasonable period for the purposes of performing, tracing and evidencing the order, after-sales service, claims, warranty, or reprinting at the customer's request. By default, Symbio3D retains the source files provided and/or production files for 12 months after delivery, unless otherwise requested by the customer or required by technical/legal constraints.

3.2.29 Deletion on request
The customer may request the deletion of all or part of the Elements provided, by e-mail to contact@symbio3d.com. Symbio3D will carry out the deletion within a reasonable time, subject to legal retention obligations, to the minimum retention needed to handle disputes, claims and warranties, and to technical backups which may require a purge period. The customer is informed that deletion may prevent any identical reprint without the Elements being sent again.

3.2.30 Archiving on request
At the customer's request (in particular business customers) and subject to Symbio3D's acceptance, a dedicated archiving service (duration, access conditions, any fees) may be set up by written agreement.

3.2.31 Liability - use of printed parts (B2C & B2B)
The customer acknowledges that, unless expressly stated in the quotation, Symbio3D provides a manufacturing service on the basis of the Elements provided or approved by the customer. By default, Symbio3D does not carry out any design/engineering, sizing, functional validation, regulatory compliance validation or certification work. Consequently, Symbio3D does not warrant that the parts are suitable for any standards, certifications, mechanical constraints, sector regulations or specific legal requirements related to the end use. It is the customer's responsibility to verify, at their own risk, that the printed part meets the requirements applicable to its use, in particular through appropriate tests, validations and inspections.

The parts produced are not designed or intended for use as toys or objects handled by children or animals, unless explicitly validated in the quotation. This clause does not exclude or limit the legal guarantees applicable to consumers, nor Symbio3D's liability in the event of non-conformity with the quotation or fault attributable to it.

Where the parts produced are distributed, marketed or made available to third parties (including free of charge or for promotional purposes), the Customer is deemed to act as a manufacturer within the meaning of the applicable regulations. As such, it is their responsibility to ensure that the products comply with the legal and regulatory requirements in force, in particular regarding safety, user information, labelling and, where applicable, certification or marking.

Article 4 - Prices and payment terms

4.1 Pricing
  • Prices are expressed in euros, inclusive of all taxes for consumers
  • Prices exclusive of tax apply to business customers, with VAT shown separately
  • A personalised quotation is drawn up for each project not covered by the “Online 3D printing” service
4.2 Payment terms

For 3D prints:
Payment upon ordering or before production starts. A 50% deposit is possible for runs of 100 parts or more.

For digital files:
Full payment before modelling and download.
Accepted payment methods: bank card, PayPal, bank transfer

4.3 Late payment

a) Business customers (B2B): in the event of late payment, penalties shall be payable automatically from the day after the due date, at a rate of 1.5% per month of delay (or, failing that, at the rate provided for by the applicable regulations). A fixed recovery indemnity of €40 is also due for each invoice paid late.

b) Consumer customers (B2C): in the event of late payment, interest at the statutory rate may be applied, together with reimbursement of the recovery costs actually incurred, within the limits provided for by law.

4.4 Retention of title

Symbio3D retains ownership of the goods sold until full and effective payment of the price (principal, costs and taxes). In the event of non-payment, Symbio3D may reclaim the goods. Risk passes in accordance with Article 5.2.

Article 5 - Lead times and delivery terms

5.1 Production lead times

The production lead times below are indicative and run from the first of the following dates: (i) receipt by Symbio3D of the written acceptance of the quotation, (ii) receipt of the payment (or the agreed deposit), and (iii) receipt of all usable Elements and required validations (files, material, colour, finish, tolerances, quantity, delivery address). Any delay or change request by the customer may push back the lead times.

  • 3D printing: 1 to 10 working days depending on complexity
  • 3D modelling: 3 to 15 days depending on the project
  • 3D scanning: 1 to 5 days depending on the number of parts
5.2 Physical delivery

Shipping: by carrier, at the customer's expense.

Transfer of risk:
Consumer customers (B2C): all risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer (other than the carrier proposed by Symbio3D), takes physical possession of the goods.
Business customers (B2B): risk passes upon handover of the goods to the carrier or upon collection by the customer.

5.3 Force majeure

Lead times may be suspended in the event of unforeseeable and unavoidable events (pandemic, strike, natural disaster, supplier failure). If the force majeure event continues for more than 60 days, the contract may be terminated.

5.4 Receipt of parcels - Reservations - Damage - Missing/lost parcels

a) Checking upon receipt (B2C & B2B)
The customer is invited to check the apparent condition of the parcel and the conformity of the delivery at the time of handover (parcel, quantity, references). In the event of an apparent anomaly, the customer is invited to record precise, reasoned written reservations on the delivery note and, where possible, to take photographs.

b) Notifying Symbio3D (B2C & B2B)
The customer shall inform Symbio3D of any anomaly as soon as possible, ideally within 48 working hours of receipt, by e-mail to contact@symbio3d.com, attaching photos, a description of the problem and any reservations recorded on the delivery note. This recommendation is intended to facilitate the handling of the case and does not deprive consumers of their statutory rights.

c) Time limits for claims against the carrier (B2B)
For business customers, it is the consignee's responsibility to send the carrier a reasoned protest within the statutory time limits in order to preserve any claims against the carrier.

d) Parcel marked “delivered” but not received / Lost parcel (B2C & B2B)
If a parcel is marked as delivered but has not been received, or is presumed lost, the customer undertakes to inform Symbio3D as soon as possible so that an investigation can be opened with the carrier. Symbio3D may request any useful information (address confirmation, circumstances, sworn statement, police report in the event of proven theft).

e) Settlement of the dispute (B2C)
For consumers, Symbio3D remains responsible for the proper performance of the delivery obligation in accordance with the French Consumer Code; the reservation and notification steps are intended to facilitate the investigation and compensation of the claim.

Article 6 - Right of withdrawal

6.1 Consumers (private individuals)

In accordance with the law, consumers have a withdrawal period of 14 calendar days:

  • For non-customised physical products: from receipt
  • How to withdraw: written notice to Symbio3D's e-mail or postal address
6.2 Exclusions from the right of withdrawal

The following are excluded from the right of withdrawal:

  • Digital content supplied without a tangible medium (digital files) where performance has begun before the end of the withdrawal period and, where the contract places the consumer under an obligation to pay, after the consumer's prior express consent and express acknowledgement that they thereby lose their right of withdrawal.
  • Customised parts or parts made to the customer's specifications
  • Goods damaged by the customer after delivery
6.3 Refund

In the event of a valid withdrawal, Symbio3D shall refund the consumer all sums paid, including the initial delivery costs (at the standard rate), within 14 days of the date on which Symbio3D is informed of the decision to withdraw. Symbio3D may defer the refund until the goods have been recovered or the consumer has provided proof of shipment. Return costs are borne by the consumer, unless otherwise agreed or required by law.

6.4 Model withdrawal form (Annex)

Article 7 - Legal guarantees

7.1 Legal guarantee of conformity

In accordance with Articles L.217-3 et seq. of the French Consumer Code:

  • Duration: 2 years from delivery
  • Scope: conformity of the product with the specifications in the quotation
  • Implementation: repair or replacement free of charge within 30 days
7.2 Guarantee against hidden defects

In accordance with Articles 1641 et seq. of the French Civil Code:

  • Time limit for action: 2 years from discovery of the defect
  • Conditions: a hidden defect rendering the product unfit for its use
7.3 Specific guarantees for digital files
  • Printability guarantee: files guaranteed compatible with printers meeting the stated minimum specifications
  • Free correction: in the event of a proven technical error, a corrected version is provided within 30 days
  • Exclusions: incompatibility due to faulty equipment or inappropriate print settings

Article 8 - Limitation of liability

8.1 General limitations

Symbio3D accepts no liability for:

  • inappropriate use of printed products (mechanical use under stress without validation)
  • changes made to the 3D files by the customer
  • indirect damage: business interruption, loss of profit, loss of data
8.2 Cap

In any event, Symbio3D's liability is capped at the amount of the order concerned.

8.3 Specialised use

Symbio3D cannot be held liable for the use of parts in critical applications (medical, aeronautics, automotive) without appropriate prior technical validation.

8.4 Risks associated with printed parts

The customer acknowledges that parts produced by additive manufacturing may have specific characteristics related to the processes and materials used, in particular:

  • the possible presence of small parts or detachable elements which may present an ingestion or choking hazard,
  • risks of breakage or fracture which may create sharp edges or potentially cutting fragments,
  • variable mechanical strength depending on the conditions of use (temperature, stresses, material ageing).

Consequently, unless expressly stated in the quotation, the parts produced by Symbio3D are not intended:

  • to be used as toys
  • to be handled by children
  • to be used by animals
  • or for uses involving contact with vulnerable persons.

The customer undertakes to verify that the part is suitable for its use and to take all necessary safety measures before any use.
Symbio3D cannot be held liable for damage resulting from inappropriate or unsafe use of the parts.

Article 9 - Intellectual property

9.1 Customer files and designs - Warranties and indemnification

The customer represents and warrants that they hold all rights, licences and authorisations necessary in relation to the files, designs, models, drawings, logos, trademarks, texts or elements provided to Symbio3D, as well as the right to request their manufacture, reproduction and, where applicable, exploitation.

The customer warrants in particular that the Elements provided do not infringe third-party rights, including (without limitation) patents, trademarks, designs, copyright, trade secrets or third-party licences.

The customer undertakes to indemnify Symbio3D (and its officers, employees and subcontractors) against any action, claim, judgment, damage, loss and costs (including reasonable defence costs) resulting from an alleged or proven infringement of intellectual property rights related to the Elements provided by the customer or to the customer's instructions.

This indemnity does not apply where the claim results exclusively from a modification of the Elements by Symbio3D outside the customer's instructions.

9.2 Symbio3D creations
  • Original files created by Symbio3D remain protected by copyright
  • A personal-use licence is granted unless otherwise stated
  • Commercial use of digital files sold is subject to specific licence terms
9.3 Digital files sold

Standard licence of use:

  • Permitted use: personal printing, internal prototyping or explicit agreement
  • Prohibited use: resale, distribution, modification for commercial purposes
  • Territory: worldwide for personal use, France for professional use unless otherwise agreed

Article 10 - Protection of personal data (GDPR) and Confidentiality

10.1 Data controller

Symbio3D, as data controller, undertakes to comply with the General Data Protection Regulation (GDPR).

10.2 Data collected and purposes

Identification data: surname, first name, e-mail, address
Purposes: order processing, invoicing, customer service
Legal basis: performance of the contract and legitimate interest

10.3 Rights of data subjects

You have the rights of access, rectification, erasure, portability, restriction and objection. To exercise them, write to contact@symbio3d.com

10.4 Retention

Active customers: for the duration of the business relationship
Prospects: 3 years from the last contact
Accounting data: 10 years in accordance with legal obligations

10.5 Definition of confidential information

Confidential information means any information, data or documents communicated by the Customer to Symbio3D, or which Symbio3D accesses in the course of performing the order, in any form whatsoever, in particular: 3D files (STL/STEP/OBJ/3MF…), drawings, sketches, specifications, prototypes, measurement data, processes, commercial information, prices, volumes, correspondence, as well as any information marked as confidential or whose confidential nature can reasonably be inferred from its nature.

10.6 Symbio3D's undertakings

Symbio3D undertakes to: use confidential information only to analyse, quote, manufacture, inspect, ship and/or provide the service ordered; not to disclose confidential information to third parties, except in the cases provided for in Article 10.8; limit access to those with a need to know; and implement reasonable protective measures.

10.7 Exclusions

Information is not confidential where Symbio3D can demonstrate that it entered the public domain without breach of these Terms, that it was already lawfully known, that it was lawfully received from a third party, or that it was developed independently.

10.8 Authorised disclosures and legal obligations

Symbio3D may disclose confidential information to its service providers strictly necessary for the performance of the order, on a need-to-know basis and subject to a confidentiality obligation, or where required to do so by law, regulation or a decision of an authority or court, limiting the disclosure to what is strictly necessary and, where legally possible, informing the customer.

10.9 Duration

The confidentiality obligations apply throughout the contractual relationship and for five (5) years from the end of the order or the last confidential exchange, unless a longer period is required by law or by a protected secret.

10.10 Deletion / return of files and technical data

Except where retention is required by law or technically necessary for after-sales service and warranties, Symbio3D may retain files and technical information for a reasonable period. The customer may request deletion of the source files provided, by e-mail to contact@symbio3d.com, subject to legal obligations and to the minimum retention needed to handle claims and warranties or to evidence the order. Deletion may prevent any identical reprint without the customer re-sending the files.

10.11 Compliance with mandatory consumer rights

This article in no way limits the statutory rights of consumer customers, in particular under the legal guarantees and the public-policy rules of the French Consumer Code.

10.12 Provisions specific to business customers (B2B)

This Article 10.12 applies only to customers acting in a professional capacity.

a) Transmission and security of exchanges
Business customers are responsible for the choice of transmission means and shall ensure they are suited to the sensitivity of the information transmitted. Symbio3D cannot be held liable for unauthorised access or interception occurring beyond its control, in particular before the Elements are actually received by Symbio3D or after they are handed back to the customer through the channel chosen by the customer.

b) Mutual confidentiality
Where Symbio3D communicates to a business customer non-public information about its methods, prices, quotations, processes, or technical or commercial documents, such information is treated as confidential under the same conditions as the customer's information, for the period set out in Article 10.9.

c) Compensation - Penalty clause (capped)
In the event of a proven breach by a business customer of its confidentiality obligations, the business customer shall owe, by way of penalty clause, a fixed indemnity of €2,000 per breach, increased by €500 per week that the breach persists after formal notice has remained without effect. This penalty clause is cumulative with compensation for the reasonable costs incurred to bring the breach to an end.

d) Protective measures
In the event of a breach, or an imminent risk of a breach, of confidentiality, Symbio3D may seek any protective measure or injunction necessary to bring the breach to an end.

e) Subcontracting (business customers)
Symbio3D may use subcontractors strictly necessary for performance, subject to an equivalent confidentiality undertaking and access limited to a need-to-know basis.

f) Non-application to consumers
The provisions of this Article 10.12 do not apply to consumer customers.

Article 11 - Special terms - Sale of digital files

11.1 Delivery

Immediate access once payment is confirmed
Formats provided: optimised STL, and possibly OBJ, STEP or 3MF depending on the product
Documentation: printing instructions and recommended settings

11.2 Licence of use for private individuals

CC BY-NC (Creative Commons Attribution - NonCommercial) by default:

11.3 Licence of use for business customers

11.4 Technical support

Assistance: e-mail support for printing issues or printed-part issues
Response time: 48 working hours
Limits: support restricted to original, unmodified files

Article 12 - Dispute resolution

12.1 Consumer mediation

12.2 Governing law and jurisdiction

Governing law: French law
Competent courts: the courts of the place where Symbio3D's registered office is located
Exception: for consumers, the courts of the consumer's place of residence

Article 13 - General provisions

13.1 Acceptance

Placing an order implies full and unreserved acceptance of these Terms.

13.2 Amendment

Symbio3D reserves the right to amend these Terms. Amendments apply to orders placed after their publication.

13.3 Severability

If any clause is held to be void, the other clauses shall remain fully valid.

13.4 Archiving

Electronic communications are archived and constitute evidence of the contractual relationship.

Article 14 - Reviews and user-generated content

14.1 Posting reviews

The site may allow customers to post reviews, comments, ratings and/or content (the “Reviews”) relating to Symbio3D's products and services. Reviews are published under the responsibility of their author.

14.2 Prohibited content

The customer shall not publish any Review containing, in particular: (i) defamatory, insulting, hateful, discriminatory, violent or harassing remarks, (ii) obscene or unlawful content or content contrary to public order, (iii) misleading or manifestly inaccurate information, (iv) third parties' personal data (address, phone number, e-mail, etc.) without a legal basis, (v) content infringing third parties' intellectual property rights (texts, images, trademarks, etc.), (vi) any content unrelated to the subject of the Review or intended to harm Symbio3D or a third party.

14.3 Moderation, removal and retention

Symbio3D reserves the right, without obligation, to moderate Reviews before or after publication and to refuse, hide, delete or request the modification of any Review that does not comply with these Terms, is manifestly unlawful, or is likely to engage Symbio3D's liability or infringe a third party's rights. Symbio3D may retain elements enabling it to handle a complaint or ensure the traceability of Reviews in accordance with legal obligations.

14.4 Liability

To the extent permitted by the applicable regulations, Symbio3D cannot be held liable for the content of Reviews published by users, which express the personal opinion of their author. Reviews do not constitute a guarantee of performance or fitness for a particular purpose. Symbio3D remains responsible for its own content and official communications.

14.5 Reporting

Anyone may report a Review they consider unlawful or infringing their rights by writing to contact@symbio3d.com, stating the URL (or the page concerned), the content in question and the reason for the report. Symbio3D will examine the report within a reasonable time and take appropriate action where necessary.
