Article 2 - Purpose of the ToU and Description of the Services Offered

2.1 Purpose of the ToU
The purpose of these Terms of Use (hereinafter the "ToU") is to define the terms and conditions of use of the website www.symbio3d.com (hereinafter the "Site") published by Symbio3D.

Use of the Site implies full and unreserved acceptance of these ToU by the User.

2.2 Description of the services

Symbio3D offers the following services:

  • Online 3D printing: Manufacture of parts from 3D files provided by the customer
  • 3D modeling: Creation or modification of 3D files according to the customer's specifications
  • Support: Comprehensive support for customer projects
  • Series 3D printing: 3D printing of small and medium production runs from 3D files provided by the customer
  • Inventory optimization: Virtualization of certain parts of the customer's inventory so they can be 3D printed on demand
  • Technical advice: support with 3D printing projects
 

Article 3 - Conditions of Access to and Use of the Site

3.1 Access to the site
Access to the Site is free of charge for consulting general information. Certain services may require prior registration.

The User warrants that they have the legal capacity required to accept these ToU and to use the Site in accordance with its terms.

3.2 Conditions of use
The User undertakes to:

  • Use the Site in accordance with its intended purpose and these ToU
  • Not interfere with the proper functioning of the Site
  • Not use the Site for illegal or unlawful purposes
  • Respect the intellectual property rights of Symbio3D and third parties
  • Not distribute content contrary to public order and morality
 

3.3 Service availability
Symbio3D endeavors to keep the Site available 24 hours a day, 7 days a week. However, interruptions may occur for maintenance reasons or due to force majeure. Symbio3D cannot be held liable for temporary interruptions of the Site.

Article 4 - Creation of a User Account

4.1 Registration
To access certain services, the User may create an account by providing accurate and up-to-date information. The User undertakes to keep their login credentials confidential.

4.2 Account responsibility
The User is solely responsible for the use of their account and for the actions carried out using their credentials. In the event of fraudulent use, the User must immediately inform Symbio3D.

4.3 Account suspension/deletion
Symbio3D reserves the right to suspend or delete an account in the event of non-compliance with these ToU, without notice and without compensation.

Article 5 - Intellectual Property in Content, Models and 3D Files

5.1 Symbio3D's property
All elements of the Site (structure, texts, images, logos, videos, etc.) are protected by intellectual property law and belong to Symbio3D or to third parties who have authorized their use.

5.2 3D files created by Symbio3D
3D models created by Symbio3D remain its exclusive property. Any commercial use or reproduction requires prior written authorization. Where necessary, a transfer of ownership may be carried out.

5.3 Files provided by the User
The User warrants that they hold all the necessary rights to the files they submit to Symbio3D. They undertake to indemnify Symbio3D in the event of any third-party claim relating to the intellectual property of these files.

5.4 Respect for third-party rights
The User undertakes not to upload, share or print models that infringe the intellectual property rights of third parties.

Article 6 - Responsibilities of the User and the Publisher

6.1 User's responsibility
The User is responsible for:

  • Their use of the Site and its services
  • The accuracy of the information they provide
  • Compliance with intellectual property rights
  • The consequences of their downloads and orders
  • The security of their equipment and data
 

6.2 Publisher's responsibility
Symbio3D undertakes to:

  • Provide accurate information about its services
  • Meet the communicated deadlines as far as possible
  • Protect personal data in accordance with the GDPR
  • Ensure the technical quality of its 3D printing services
 

Article 7 - Limitation of Liability

7.1 General limitation
Symbio3D cannot be held liable in the following cases:

  • Inappropriate use of the printed products by the User
  • Damage resulting from modification of the files by the User
  • Temporary interruption of the Site for maintenance
  • Acts of third parties or force majeure events
  • Non-compliant use of downloaded files
 

7.2 Specific exclusions
Symbio3D disclaims all liability for:

  • The mechanical function of printed parts used outside their intended purpose
  • The consequences of unauthorized commercial use of the files
  • Indirect or intangible damage
  • Loss of data or operating losses
 

7.3 Cap on liability
In any event, Symbio3D's liability is limited to the amount of the sums actually received by Symbio3D for the service concerned.

Article 8 - Personal Data Management (GDPR Compliance)

8.1 Data collection
Symbio3D collects the personal data necessary for the operation of the Site and the provision of its services (surname, first name, e-mail address, postal address, telephone number).

8.2 Purposes of processing
The data is processed for:

  • Managing user accounts
  • Processing orders
  • Commercial communication (with consent)
  • Improving services
  • Complying with legal obligations
 

8.3 Legal basis
The processing is based on:

  • Performance of the contract for orders
  • Legitimate interest for the improvement of services

Article 10 - Procedures for Amending and Updating the ToU

10.1 Right to amend
Symbio3D reserves the right to amend these ToU at any time to adapt to legal, technical or commercial developments.

10.2 Informing users
Any amendment will be brought to the Users' attention by publication on the Site. The date of the last update is indicated at the top of the ToU.

10.3 Acceptance of amendments
Continued use of the Site after amendment of the ToU constitutes acceptance of the new terms. In case of disagreement, the User must stop using the Site.

Article 11 - Applicable Law and Jurisdiction

11.1 Applicable law
These ToU are governed by French law. Any difficulty of interpretation will be resolved in accordance with French legislation.

11.2 Competent jurisdiction
In the event of a dispute, the French courts shall have sole jurisdiction. For disputes with consumers, the competent court shall be that of the consumer's place of residence or of Symbio3D's registered office.

11.3 Mediation
In accordance with the applicable regulations, Symbio3D is a member of the following mediation scheme: [name and contact details of the mediator].

Article 12 - Miscellaneous Provisions

12.1 Partial invalidity
If any clause of these ToU is declared null and void, the other clauses shall remain valid.

12.2 Entire agreement
These ToU constitute the entire agreement between Symbio3D and the User regarding the use of the Site.

12.3 Waiver
Symbio3D's failure to exercise a right provided for in these ToU shall not constitute a waiver of that right.

By using the Site, the User acknowledges having read these ToU and accepts them without reservation.
